The search was performed using key words input to a commercial computer database. This search is an excellent first step in exploring what you may be able to do to protect your idea or to check for infringement. However, there are limitations to this initial search and you should be aware of them. For Patent Searches: - The computer database contains documents only back to the 1940's and in some cases older. Patent documents exist back to 1840 at the Patent & Trademark Office (P.T.O.) in Arlington, Virginia.
- The search contains only U.S. Patent Documents. At the P.T.O. many foreign documents exist including patents from Japan, Germany, and France. These foreign documents could be significant.
- The P.T.O. has a staff of several thousand examiners. If you make a patent application the Examiner who searches prior art relative to your idea will be an expert in that field. The examiner has spent years searching patents, reading magazines and talking to other experts in this one field. He could therefore turn up patents a computer search could not.
- The search might miss brand-new patents and applications. An Examiner would have these available.
- Upon applying for a patent, many patent attorneys will want to conduct a more complete search.
For Trademark Searches: - The database does not contain unregistered trademarks. But if someone is already using an unregistered trademark like yours they could prevent you from registering yours.
- Again an expert Examiner at the Patent and Trademark Office (P.T.O.) has access to new documents and years of work in the field and will likely conduct the best search.
- The computer search is based primarily on words; similar logos or packaging can also play a role in trademark infringement.
